Plain English. No copy-paste legalese. These are the rules of the road when you shop with HERBIE, join as a Member, or use anything we publish online.
01. The Basics
By browsing herbie.co, creating an account, or placing an order, you're agreeing to these Terms. If you don't agree, that's cool — but please don't use the site. These Terms are a contract between you and HERBIE Athletic Co., an Oregon corporation headquartered in Portland.
You must be at least 16 years old to create an account or place an order. If you're under 18, you confirm a parent or guardian has reviewed and agreed to these Terms with you.
02. Your Account
You can shop without an account, but creating one unlocks order tracking, faster checkout, Member benefits, and your wishlist. You're responsible for keeping your login info secure and for any activity under your account.
- Use a real email — that's how we send order updates and recovery links.
- Don't share your password or let someone else use your account.
- Tell us immediately at [email protected] if you suspect unauthorized access.
- We can suspend or close accounts that abuse the system, exploit promos, or violate these Terms.
03. Orders & Payment
An order is an offer from you to buy. We accept it when we send a confirmation email and charge your card. Until then, we reserve the right to cancel or limit any order — for example, if a product was mispriced, out of stock, or flagged as fraudulent.
Pricing
All prices are in U.S. Dollars unless shown otherwise. Sales tax is calculated at checkout based on your shipping address. International duties and taxes are not included and are the buyer's responsibility.
Payment
We accept major credit/debit cards, Apple Pay, Google Pay, Shop Pay, PayPal, and Klarna (where available). You authorize us — or our payment processor — to charge the full order total at the time of purchase.
We don't tack on "convenience fees," "processing fees," or any other shady surcharges. The price you see at checkout is the price you pay.
04. Shipping & Returns
Domestic orders ship within 48 hours. Free shipping on orders over $75. International shipping starts at $18. Full timing details live on our FAQ page.
60-Day Returns
You've got 60 days from delivery to send unworn gear back for a full refund. Tags must be attached, and the product must be in resalable condition. Defective items are covered under our Lifetime Warranty (see § 05) instead.
Exchanges
Free for size swaps. Use the Returns Portal, choose "exchange," and we'll ship the replacement the day we receive yours.
Final Sale
Items marked Final Sale at checkout — typically deeply discounted closeouts — can't be returned or exchanged. They're called final sale for a reason.
05. Lifetime Warranty
Every piece of HERBIE footwear and hard goods carries our Lifetime Warranty against manufacturing defects — midsole compression, sole separation, stitching failure, hardware failure. We'll repair or replace covered defects free, indefinitely.
Not covered: normal wear (worn-down outsoles, frayed laces, faded fabric), damage from accidents or misuse, products bought from unauthorized resellers, and anything modified after purchase. We do offer 30% off a replacement for normal wear-and-tear cases.
To file a claim, email [email protected] with your order number and a few photos. We respond within 2 business days.
06. Membership
Membership is free. Members get 24-hour early access to drops, free shipping on every order, exclusive colorways, and invites to local events. We don't charge for it and we won't start charging without telling you first.
- One Member account per person. No bulk-buying, reselling, or bot purchases.
- We can revoke Member status if you abuse the early-access window (e.g., buying entire size runs to flip on resale sites).
- Member benefits aren't transferable.
07. Intellectual Property
The HERBIE name, logo, wordmark, monogram, drop names ("AIR VOLT," "Never Settle," etc.), product designs, photography, copy, and all site content are owned by HERBIE Athletic Co. or licensed to us.
You may not copy, reproduce, scrape, or use our content for commercial purposes without written permission. You can absolutely share, link to, and post photos of your own HERBIE gear — that's encouraged. Tag us.
08. User Content
If you post a review, comment, photo, or video on our site or social channels mentioning HERBIE, you grant us a non-exclusive, royalty-free, worldwide license to use that content for marketing — on our site, in emails, on social, in ads. We always credit @your-handle when we repost.
Don't post anything that's illegal, infringing, harassing, or that you don't have rights to. We can remove user content at our discretion.
09. Disclaimers
HERBIE products are designed for athletic use and built to high quality standards, but performance gear isn't risk-free. Listen to your body, follow product care instructions, and consult a professional before starting a new training program.
The site is provided "as is." We don't warrant that it'll always be available, bug-free, or that the information is 100% accurate. We do try really hard, though.
10. Limitation of Liability
To the maximum extent allowed by law, HERBIE's total liability for any claim related to a product or this site is capped at the amount you paid for the product in question. We're not liable for indirect, incidental, or consequential damages — like lost profits, lost data, or hurt feelings.
Some states don't allow these limits, so parts of this section may not apply to you.
11. Disputes & Governing Law
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-laws rules. We'll always try to resolve disputes informally first — email [email protected] and a real human will get back to you within 2 business days.
If informal resolution fails, disputes will be resolved through binding arbitration in Multnomah County, Oregon, under the rules of the American Arbitration Association — except for small-claims court matters and IP disputes, which can go to court directly.
You and HERBIE agree to bring claims only in your individual capacity, not as part of a class action or representative proceeding.
12. Changes & Contact
We may update these Terms from time to time. If changes are material, we'll email registered users and post a notice on the site at least 14 days before they take effect. Continuing to use HERBIE after that means you accept the new Terms.
